Abortion in West Virginia

Women’s Health Center of West Virginia has been forced to pause abortion care until further notice. West Virginia legislators passed a near total abortion ban on September 13, 2022. The abortion ban has extremely narrow exceptions including:

  • Protecting the life of the pregnant person

  • Rape and incest (up to 8 weeks for adults and 14 weeks for minors or incapacitated adults; abuse must be reported to qualified law enforcement). Abortions must be reported to parents/guardians at least 48 hours prior to performing the abortion.

  • All abortions must be performed by a physician with admitting privileges at a West Virginia hospital.

  • Abortifacients cannot be prescribed via telehealth.

  • Licensed medical professionals who perform an illegal abortion can be reported by anyone to the licensure board and could lose their license to practice medicine in the state of West Virginia.

Provisions of HB 302

  • Exception for life of the pregnant person.

  • 14-week exception for minors and incapacitated adults who are victims of rape/incest. The victim must report their abuse to “qualified law enforcement”. Abortions must be reported to parents/guardians 48 hours prior to performing the abortion.

  • 8-week exception for adults who are victims of rape/incest with a coinciding report to “qualified law enforcement”.

  • All abortions must be performed by an MD or DO with admitting privileges at a West Virginia hospital.

  • Abortifacients cannot be prescribed via telehealth.

  • Licensed medical professionals who perform an illegal abortion can be reported by anyone to the licensure board and could lose their license to practice medicine in the state of West Virginia.
